Needs to be understood in the context of Public Domain being VERY hard to determine even within one set of laws like America, let alone internationally. Available to access by everyone, is not the same thing as being in the Public Domain.

or are proprietary to the institutions using them. I’m not an expert, but companies are increasingly relying on synthetic, proprietary, or purpose-built datasets to train AI.

I'm aware of many products that use proprietary data for context training, but none that use only it (and PD work) for a foundation model.
